歲末年初,在各地加快申報第四批增量配電業務改革試點項目之際,國家發改委和國家能源局聯合下發了《關于進一步推進增量配電業務改革的通知》(發改經體〔2019〕27號),各方反響強烈。《通知》包括四部分,共三十條具體措施,為深入推進增量配電業務改革工作指明了方向。
筆者認為,通(tong)(tong)過多措并舉“打補丁”,完善升級增(zeng)量配電業務改革的頂層設計,推動改革落地是《通(tong)(tong)知》出臺的初衷;圍繞增(zeng)量放開,著眼“進一步推進”,瞄(miao)準重難點問(wen)題,靶向施策是貫穿全(quan)篇的主線。
前三批試點進展相對遲緩
2016年(nian)11月以來,國(guo)家(jia)發改委、國(guo)家(jia)能源局(ju)先(xian)后啟(qi)動了3批(pi)320個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)增量配(pei)電業(ye)務(wu)改革試(shi)(shi)點(dian),各(ge)地投資積(ji)極性很(hen)高。據了解(jie),截(jie)至2018年(nian)底,第(di)一批(pi)106個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)試(shi)(shi)點(dian)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)(mu)(mu)(mu)全部(bu)(bu)(bu)或部(bu)(bu)(bu)分建(jian)成33個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge),在建(jian)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)(mu)(mu)(mu)12個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge),開(kai)展前期(qi)工(gong)作(zuo)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)(mu)(mu)(mu)50個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge),取(qu)得(de)(de)電力業(ye)務(wu)許(xu)可(ke)證40個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge);第(di)二批(pi)89個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)試(shi)(shi)點(dian)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)(mu)(mu)(mu)中全部(bu)(bu)(bu)或部(bu)(bu)(bu)分建(jian)成項(xiang)(xiang)(xiang)目(mu)(mu)(mu)(mu)(mu)(mu)10個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge),在建(jian)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)(mu)(mu)(mu)4個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge),開(kai)展前期(qi)工(gong)作(zuo)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)(mu)(mu)(mu)41個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge),取(qu)得(de)(de)電力業(ye)務(wu)許(xu)可(ke)證7個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge);第(di)三批(pi)125個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)試(shi)(shi)點(dian)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)(mu)(mu)(mu)中全部(bu)(bu)(bu)或部(bu)(bu)(bu)分建(jian)成項(xiang)(xiang)(xiang)目(mu)(mu)(mu)(mu)(mu)(mu)5個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge),在建(jian)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)(mu)(mu)(mu)1個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge),開(kai)展前期(qi)工(gong)作(zuo)項(xiang)(xiang)(xiang)目(mu)(mu)(mu)(mu)(mu)(mu)24個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge),取(qu)得(de)(de)電力業(ye)務(wu)許(xu)可(ke)證2個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)。總體來看,增量配(pei)電業(ye)務(wu)試(shi)(shi)點(dian)進展相對緩(huan)慢,投產運行項(xiang)(xiang)(xiang)目(mu)(mu)(mu)(mu)(mu)(mu)偏少。
試(shi)(shi)(shi)點(dian)(dian)(dian)推動(dong)工(gong)作(zuo)高(gao)頻次開展(zhan)。近(jin)半(ban)年(nian)來(lai),國(guo)家(jia)層面開展(zhan)了(le)一(yi)系(xi)列工(gong)作(zuo),加(jia)快推動(dong)試(shi)(shi)(shi)點(dian)(dian)(dian)項(xiang)目(mu)落地(di)(di)見(jian)效。2018年(nian)8月,國(guo)家(jia)發(fa)改(gai)委(wei)(wei)和國(guo)家(jia)能源局(ju)(ju)(ju)組(zu)(zu)成(cheng)6個(ge)督導調研(yan)組(zu)(zu),分赴14個(ge)省(sheng)(區、市)調研(yan);2018年(nian)10月9日(ri)(ri),國(guo)家(jia)發(fa)改(gai)委(wei)(wei)和國(guo)家(jia)能源局(ju)(ju)(ju)印發(fa)《關(guan)于增(zeng)(zeng)量(liang)配(pei)電業務(wu)改(gai)革第一(yi)批試(shi)(shi)(shi)點(dian)(dian)(dian)項(xiang)目(mu)進展(zhan)情況(kuang)的通報(bao)》(發(fa)改(gai)經體〔2018〕1460號(hao)),重(zhong)點(dian)(dian)(dian)通報(bao)了(le)進展(zhan)緩慢和問題突出的試(shi)(shi)(shi)點(dian)(dian)(dian)項(xiang)目(mu),并明確要求第一(yi)批試(shi)(shi)(shi)點(dian)(dian)(dian)項(xiang)目(mu)應于2019年(nian)6月底前(qian)建成(cheng)投運。2018年(nian)10月11日(ri)(ri),國(guo)家(jia)發(fa)改(gai)委(wei)(wei)會同國(guo)家(jia)能源局(ju)(ju)(ju)約談了(le)遼寧、浙江、江西、山東、河南、四川省(sheng)相關(guan)部門(men)和省(sheng)級電網公(gong)司(si),明確要求地(di)(di)方政(zheng)府相關(guan)部門(men)要切實履行職責,加(jia)強協調推動(dong),電網公(gong)司(si)要提(ti)高(gao)站位(wei),加(jia)大力度(du)(du)支持增(zeng)(zeng)量(liang)配(pei)電改(gai)革工(gong)作(zuo)。2018年(nian)11月22日(ri)(ri),國(guo)家(jia)發(fa)改(gai)委(wei)(wei)辦(ban)公(gong)廳、國(guo)家(jia)能源局(ju)(ju)(ju)綜合司(si)印發(fa)《關(guan)于建立增(zeng)(zeng)量(liang)配(pei)電業務(wu)改(gai)革試(shi)(shi)(shi)點(dian)(dian)(dian)項(xiang)目(mu)直(zhi)接聯系(xi)制度(du)(du)的通知》(發(fa)改(gai)辦(ban)經體〔2018〕1492號(hao)),選取12個(ge)試(shi)(shi)(shi)點(dian)(dian)(dian)項(xiang)目(mu)作(zuo)為(wei)直(zhi)接聯系(xi)點(dian)(dian)(dian),要求各有關(guan)司(si)局(ju)(ju)(ju)點(dian)(dian)(dian)對點(dian)(dian)(dian)加(jia)強指導協調,推動(dong)試(shi)(shi)(shi)點(dian)(dian)(dian)項(xiang)目(mu)盡(jin)快落地(di)(di)運行。
針(zhen)對增(zeng)量配電業(ye)務存在(zai)的實(shi)際難題,國家(jia)發改委和國家(jia)能源局于2018年(nian)上半年(nian)開始(shi)組織編制《通(tong)知》,從初稿(gao)征求意見到正式(shi)出臺歷時近一(yi)年(nian)。
《通知》折射出多項深層次矛盾
從各方反應和實際(ji)情況(kuang)看,增量配電業務改(gai)革在推進(jin)過程中主要存在以下問題:
一是(shi)業主(zhu)招標(biao)不規范(fan),公平競爭(zheng)要求未(wei)有(you)效落實。《有(you)序放開配電(dian)(dian)網業務管理辦法》(發改經(jing)體〔2016〕2120號)明確(que)要求,通(tong)過市場競爭(zheng)確(que)定投資(zi)主(zhu)體;國(guo)家發改委、國(guo)家能源(yuan)局在(zai)(zai)批復試(shi)(shi)點(dian)項(xiang)目(mu)時(shi),對(dui)此(ci)又做(zuo)了多次強調。但在(zai)(zai)實際操作中,部分地方政府在(zai)(zai)試(shi)(shi)點(dian)項(xiang)目(mu)的(de)招標(biao)環節設置前置條件(jian),人為(wei)干(gan)預招標(biao)結果,電(dian)(dian)網企業則強行要求控股,阻礙社(she)會資(zi)本進入(ru),導致(zhi)目(mu)前已確(que)定業主(zhu)的(de)項(xiang)目(mu)中,很大一部分由電(dian)(dian)網企業或地方政府投資(zi)平臺控股,社(she)會資(zi)本參與試(shi)(shi)點(dian)項(xiang)目(mu)積(ji)極性受到嚴重影響。
二是部分項目(mu)涉及的(de)(de)(de)電(dian)(dian)網存(cun)(cun)量(liang)資(zi)(zi)產(chan)處置(zhi)困難(nan)。對(dui)于涉及電(dian)(dian)網企業(ye)存(cun)(cun)量(liang)資(zi)(zi)產(chan)的(de)(de)(de)項目(mu),《增(zeng)量(liang)配(pei)電(dian)(dian)業(ye)務(wu)配(pei)電(dian)(dian)區域劃分實施辦法(試行)》(發(fa)改(gai)能源(yuan)規(gui)〔2018〕424號)明確了入股、出售、產(chan)權置(zhi)換(huan)、租(zu)賃等4種處置(zhi)方式。但在實際(ji)操作中,由(you)于資(zi)(zi)產(chan)管理體制和模式、決策責任、觀念(nian)認識、處置(zhi)標準等因素的(de)(de)(de)交織影(ying)響(xiang),導致存(cun)(cun)量(liang)資(zi)(zi)產(chan)處置(zhi)裹足不前,增(zeng)量(liang)存(cun)(cun)量(liang)融合發(fa)展的(de)(de)(de)活力難(nan)以釋放(fang)。
三是配(pei)電區(qu)(qu)域(yu)劃分困難(nan)。據反(fan)映,一些試(shi)(shi)點(dian)項目(mu)(mu)(mu)在劃分配(pei)電區(qu)(qu)域(yu)時(shi),存在借避免(mian)重復建設(she)、交叉(cha)供電為(wei)由,壓縮試(shi)(shi)點(dian)項目(mu)(mu)(mu)范(fan)圍“以小(xiao)代大(da)”的(de)(de)情況(kuang),還(huan)存在將控股參股項目(mu)(mu)(mu)與配(pei)電區(qu)(qu)域(yu)劃分互為(wei)前(qian)提(ti)的(de)(de)情況(kuang)。個(ge)別地方(fang)有(you)搶建試(shi)(shi)點(dian)區(qu)(qu)域(yu)內增量(liang)配(pei)電設(she)施、擠壓增量(liang)配(pei)電業務試(shi)(shi)點(dian)范(fan)圍的(de)(de)現(xian)象。
四是(shi)(shi)對(dui)(dui)增量配(pei)電(dian)(dian)網(wang)規(gui)劃不(bu)重(zhong)視,規(gui)劃工作(zuo)流于形式。不(bu)少(shao)地方(fang)政府或項目(mu)業主在推(tui)進試點的過程中,存在重(zhong)股(gu)權(quan)爭奪(duo)(duo)、重(zhong)負荷爭奪(duo)(duo)、輕電(dian)(dian)網(wang)規(gui)劃的現象,相關(guan)電(dian)(dian)網(wang)規(gui)劃工作(zuo)不(bu)能滿足項目(mu)推(tui)進的要求,導致項目(mu)在后(hou)續推(tui)進中,在存量資(zi)產處置、配(pei)電(dian)(dian)區域劃分、系(xi)統接入等方(fang)面(mian)困難重(zhong)重(zhong)。一方(fang)面(mian),這是(shi)(shi)因為各方(fang)對(dui)(dui)規(gui)劃工作(zuo)的重(zhong)要性認(ren)識不(bu)夠;另一方(fang)面(mian),也是(shi)(shi)因為從(cong)國家層面(mian)到地方(fang)層面(mian)都沒有(you)對(dui)(dui)增量配(pei)電(dian)(dian)網(wang)規(gui)劃出(chu)臺相關(guan)的規(gui)范(fan)規(gui)定。
五是項(xiang)目(mu)接(jie)入電(dian)(dian)網(wang)環(huan)節的(de)機制和(he)流程不明確(que),不利(li)于試點項(xiang)目(mu)盡早(zao)投(tou)運和(he)電(dian)(dian)網(wang)互(hu)聯互(hu)通。由(you)于電(dian)(dian)網(wang)企(qi)(qi)業(ye)對未控股、參股項(xiang)目(mu)進行信(xin)息(xi)封鎖,導致增(zeng)量配(pei)電(dian)(dian)項(xiang)目(mu)業(ye)主(zhu)難以獲取(qu)接(jie)入系(xi)統所必備的(de)電(dian)(dian)網(wang)信(xin)息(xi),無法開(kai)(kai)展(zhan)配(pei)電(dian)(dian)網(wang)接(jie)入系(xi)統規(gui)劃設(she)(she)計;在部分(fen)試點項(xiang)目(mu)中(zhong),電(dian)(dian)網(wang)企(qi)(qi)業(ye)未能及時提(ti)供增(zeng)量配(pei)電(dian)(dian)項(xiang)目(mu)并網(wang)服務,導致部分(fen)已(yi)開(kai)(kai)工(gong)項(xiang)目(mu)停滯或(huo)部分(fen)已(yi)建(jian)成的(de)配(pei)電(dian)(dian)設(she)(she)施(shi)難以開(kai)(kai)展(zhan)供電(dian)(dian)業(ye)務;甚至(zhi)有部分(fen)試點項(xiang)目(mu)因為和(he)電(dian)(dian)網(wang)企(qi)(qi)業(ye)存在分(fen)歧,未能從(cong)大電(dian)(dian)網(wang)獲取(qu)施(shi)工(gong)電(dian)(dian)源。
六是(shi)試(shi)(shi)點項(xiang)(xiang)目(mu)實際情況與申報時(shi)差距明顯,導致社會資(zi)本投(tou)資(zi)積極性(xing)受(shou)挫。部(bu)分(fen)試(shi)(shi)點項(xiang)(xiang)目(mu)在上報過程中(zhong)甄選不嚴格(ge),缺乏可行(xing)性(xing)論(lun)證(zheng),對用電(dian)增長的判(pan)斷盲目(mu)樂觀。試(shi)(shi)點項(xiang)(xiang)目(mu)開始推進后,受(shou)經濟增速(su)放緩(huan)等因素(su)影響,部(bu)分(fen)園區(qu)引(yin)進投(tou)資(zi)情況不理想,試(shi)(shi)點區(qu)域實際用電(dian)增長遠低于(yu)預期。部(bu)分(fen)試(shi)(shi)點項(xiang)(xiang)目(mu)供電(dian)區(qu)域內(nei)產業規劃(hua)仍未確定,短期內(nei)能否形(xing)成有效用電(dian)需求(qiu)尚無從判(pan)斷,項(xiang)(xiang)目(mu)建(jian)設的必要性(xing)存(cun)疑。
首次對試點項目業主構成亮明態度
《通知》第一部分重點對進一步(bu)規范(fan)項目業主確定(ding)提(ti)出要(yao)求,可(ke)以概括為(wei)“兩個不建議,一個可(ke)維持(chi)”。
“兩個(ge)不(bu)建議”即(ji)“不(bu)建議電網企(qi)業(ye)或當地地方政府投資(zi)平(ping)臺控股(gu)試(shi)點(dian)(dian)(dian)項目(mu)(mu)”,為(wei)(wei)社(she)會資(zi)本參與進一步(bu)預留(liu)空(kong)間(jian)。這也是政策層面第一次明(ming)確表達對增量配電試(shi)點(dian)(dian)(dian)項目(mu)(mu)業(ye)主構(gou)成(cheng)的(de)鮮明(ming)態度,對第二批、第三批乃至正在申報的(de)第四批試(shi)點(dian)(dian)(dian)項目(mu)(mu)提出了(le)明(ming)確的(de)要求(qiu)。“一個(ge)可維持”即(ji)“已確定(ding)(ding)業(ye)主的(de)試(shi)點(dian)(dian)(dian)項目(mu)(mu)可維持項目(mu)(mu)各(ge)投資(zi)方股(gu)比不(bu)變”,這又為(wei)(wei)已確定(ding)(ding)業(ye)主項目(mu)(mu)的(de)股(gu)權結構(gou)穩定(ding)(ding)吃了(le)“定(ding)(ding)心丸”。
試(shi)點批復以來,社會各方對電(dian)網(wang)企業(ye)不(bu)得控(kong)股(gu)試(shi)點項(xiang)目的呼聲很高(gao),認為電(dian)網(wang)企業(ye)控(kong)股(gu)或將導致(zhi)增(zeng)量(liang)配電(dian)網(wang)業(ye)務放(fang)開意義弱化、項(xiang)目管(guan)理因襲(xi)傳統電(dian)網(wang)體制、進展(zhan)遲緩、社會資本積(ji)極性不(bu)高(gao)等情況(kuang)。此(ci)次(ci)明確不(bu)建議電(dian)網(wang)企業(ye)控(kong)股(gu)試(shi)點項(xiang)目,既是對電(dian)網(wang)企業(ye)的不(bu)對稱監(jian)管(guan),也是對社會資本的支持。
地(di)(di)方政(zheng)府投資(zi)平(ping)臺控(kong)股(gu)的(de)試(shi)點(dian)項(xiang)(xiang)(xiang)目在(zai)(zai)已確定業主的(de)試(shi)點(dian)項(xiang)(xiang)(xiang)目中屢見不鮮。從積極的(de)角度(du)說,地(di)(di)方政(zheng)府投資(zi)平(ping)臺控(kong)股(gu)的(de)項(xiang)(xiang)(xiang)目在(zai)(zai)與(yu)電網企業博弈、項(xiang)(xiang)(xiang)目核準建設(she)等方面易(yi)于(yu)獲得地(di)(di)方政(zheng)府的(de)支持,促進項(xiang)(xiang)(xiang)目的(de)落地(di)(di)。但也要看(kan)到,地(di)(di)方投資(zi)平(ping)臺參(can)與(yu)易(yi)于(yu)造成國資(zi)控(kong)股(gu)主導、民(min)資(zi)進入困(kun)難、投資(zi)沖動(dong)強(qiang)、運營效率低(di)、利用行(xing)政(zheng)手段降(jiang)低(di)電價、片(pian)面追求招商引資(zi)效應等問題(ti)。
總之,從《通知》的(de)要求可以看(kan)出,國家(jia)層面希望的(de)試點項目業(ye)主,應將股權多元(yuan)化與完善企業(ye)法人治理結構相結合,國資、民(min)資相互(hu)監督(du)制衡、取長補(bu)短(duan),實現(xian)混合所有制改(gai)革和增(zeng)量配電改(gai)革協調推(tui)進。
進一步界定了增量和存量范疇
《通知(zhi)》第二部(bu)(bu)分對(dui)(dui)哪(na)些資產屬于存(cun)量(liang)(liang)(liang)(liang)配(pei)(pei)(pei)(pei)電(dian)(dian)(dian)(dian)(dian)設(she)(she)(she)施(shi),哪(na)些可納入增量(liang)(liang)(liang)(liang)配(pei)(pei)(pei)(pei)電(dian)(dian)(dian)(dian)(dian)設(she)(she)(she)施(shi)進行了明確(que)(que)。例如,《通知(zhi)》提出,“尚未(wei)(wei)核準或(huo)備案(an)(an)的(de)(de)(de)配(pei)(pei)(pei)(pei)電(dian)(dian)(dian)(dian)(dian)網(wang)(wang)(wang)項(xiang)目(mu)屬于增量(liang)(liang)(liang)(liang)配(pei)(pei)(pei)(pei)電(dian)(dian)(dian)(dian)(dian)業務范圍(wei)”,這實際是在(zai)明確(que)(que),電(dian)(dian)(dian)(dian)(dian)網(wang)(wang)(wang)公司(si)(si)內部(bu)(bu)規劃的(de)(de)(de)配(pei)(pei)(pei)(pei)電(dian)(dian)(dian)(dian)(dian)網(wang)(wang)(wang)項(xiang)目(mu),不屬于電(dian)(dian)(dian)(dian)(dian)網(wang)(wang)(wang)公司(si)(si)存(cun)量(liang)(liang)(liang)(liang)資產。“已(yi)獲核準或(huo)備案(an)(an)、但在(zai)相(xiang)關(guan)文件有效期內未(wei)(wei)開工(gong)建(jian)(jian)設(she)(she)(she)的(de)(de)(de)配(pei)(pei)(pei)(pei)電(dian)(dian)(dian)(dian)(dian)網(wang)(wang)(wang)項(xiang)目(mu)均屬于增量(liang)(liang)(liang)(liang)配(pei)(pei)(pei)(pei)電(dian)(dian)(dian)(dian)(dian)業務范圍(wei)”等要(yao)(yao)求(qiu),則(ze)是對(dui)(dui)電(dian)(dian)(dian)(dian)(dian)網(wang)(wang)(wang)公司(si)(si)建(jian)(jian)設(she)(she)(she)進度(du)的(de)(de)(de)要(yao)(yao)求(qiu)。長期以來(lai),各地工(gong)業園區對(dui)(dui)電(dian)(dian)(dian)(dian)(dian)網(wang)(wang)(wang)企(qi)業的(de)(de)(de)詬病主要(yao)(yao)存(cun)在(zai)與電(dian)(dian)(dian)(dian)(dian)網(wang)(wang)(wang)投(tou)資決(jue)策程(cheng)序慢,建(jian)(jian)設(she)(she)(she)進度(du)無法滿足園區用電(dian)(dian)(dian)(dian)(dian)需(xu)求(qiu)。今(jin)后,拖延建(jian)(jian)設(she)(she)(she)的(de)(de)(de)配(pei)(pei)(pei)(pei)電(dian)(dian)(dian)(dian)(dian)網(wang)(wang)(wang)項(xiang)目(mu)將從電(dian)(dian)(dian)(dian)(dian)網(wang)(wang)(wang)公司(si)(si)的(de)(de)(de)手中(zhong)拿出來(lai),交(jiao)給增量(liang)(liang)(liang)(liang)配(pei)(pei)(pei)(pei)電(dian)(dian)(dian)(dian)(dian)項(xiang)目(mu)業主運作。《通知(zhi)》中(zhong)對(dui)(dui)違規建(jian)(jian)設(she)(she)(she)的(de)(de)(de)相(xiang)關(guan)要(yao)(yao)求(qiu),則(ze)是對(dui)(dui)目(mu)前存(cun)在(zai)的(de)(de)(de)電(dian)(dian)(dian)(dian)(dian)網(wang)(wang)(wang)企(qi)業在(zai)試點區域(yu)內搶建(jian)(jian)配(pei)(pei)(pei)(pei)電(dian)(dian)(dian)(dian)(dian)設(she)(she)(she)施(shi)的(de)(de)(de)現象的(de)(de)(de)回(hui)應。
產(chan)(chan)權(quan)(quan)制度是社會主義市場經濟的(de)(de)基(ji)(ji)石,保護產(chan)(chan)權(quan)(quan)是堅持(chi)社會主義基(ji)(ji)本經濟制度的(de)(de)必然要(yao)求。《通知》第(七)條則是按照產(chan)(chan)權(quan)(quan)保護的(de)(de)要(yao)求,對由于(yu)歷史原因,地(di)方(fang)(fang)或(huo)用戶(hu)(hu)無償移交給(gei)電(dian)(dian)(dian)網(wang)企業(ye)運營的(de)(de)配(pei)電(dian)(dian)(dian)設施(shi)的(de)(de)產(chan)(chan)權(quan)(quan)進行(xing)了(le)明確。據了(le)解,部分(fen)電(dian)(dian)(dian)網(wang)企業(ye)曾認(ren)為,地(di)方(fang)(fang)或(huo)用戶(hu)(hu)無償移交給(gei)電(dian)(dian)(dian)網(wang)企業(ye)的(de)(de)配(pei)電(dian)(dian)(dian)設施(shi)長期以來由電(dian)(dian)(dian)網(wang)公司運營,所(suo)以必然屬于(yu)電(dian)(dian)(dian)網(wang)企業(ye)存量(liang)資產(chan)(chan)。因此,第(七)條的(de)(de)關(guan)鍵詞是“資產(chan)(chan)權(quan)(quan)”和“依(yi)法”,運營權(quan)(quan)和使用權(quan)(quan)并(bing)不能作為資產(chan)(chan)劃(hua)分(fen)的(de)(de)依(yi)據。
《有(you)序放開配(pei)電(dian)(dian)(dian)網(wang)業務(wu)管(guan)理辦法》曾明(ming)確(que):“配(pei)電(dian)(dian)(dian)網(wang)原(yuan)則上指110千(qian)(qian)伏(fu)(fu)及以(yi)下電(dian)(dian)(dian)壓等(deng)(deng)級電(dian)(dian)(dian)網(wang)和220(330)千(qian)(qian)伏(fu)(fu)及以(yi)下電(dian)(dian)(dian)壓等(deng)(deng)級工業園區(經濟開發(fa)區)等(deng)(deng)局域(yu)電(dian)(dian)(dian)網(wang)。”但(dan)在實際工作中,各方對電(dian)(dian)(dian)壓等(deng)(deng)級一直存在爭議。部分電(dian)(dian)(dian)網(wang)企業認(ren)為,220(330)千(qian)(qian)伏(fu)(fu)電(dian)(dian)(dian)壓等(deng)(deng)級屬于輸(shu)電(dian)(dian)(dian)網(wang),不應納(na)入(ru)增(zeng)量(liang)配(pei)電(dian)(dian)(dian)業務(wu)改革試點。此次《通知》第(di)(八)條(tiao)不僅明(ming)確(que)了僅具(ju)備(bei)配(pei)電(dian)(dian)(dian)功能的(de)220(330)千(qian)(qian)伏(fu)(fu)電(dian)(dian)(dian)壓等(deng)(deng)級可(ke)以(yi)納(na)入(ru)增(zeng)量(liang)配(pei)電(dian)(dian)(dian)業務(wu)改革試點,還明(ming)確(que)了“可(ke)不限于用戶(hu)專用變(bian)(bian)電(dian)(dian)(dian)站(zhan)(zhan)和終(zhong)端變(bian)(bian)電(dian)(dian)(dian)站(zhan)(zhan)”。這(zhe)就為一些配(pei)電(dian)(dian)(dian)區域(yu)大、園區負荷高、用戶(hu)電(dian)(dian)(dian)壓等(deng)(deng)級需要達到220(330)千(qian)(qian)伏(fu)(fu)的(de)試點項目指明(ming)了方向,使其可(ke)以(yi)在園區內建立僅具(ju)備(bei)配(pei)電(dian)(dian)(dian)功能的(de)220千(qian)(qian)伏(fu)(fu)環網(wang),滿足園區多家高耗能企業的(de)用電(dian)(dian)(dian)需求。
進一步構建了規劃體系
《通(tong)知》第(di)三部分(fen)從規劃職能、邊(bian)界條(tiao)件、信息獲取(qu)、編制(zhi)深度、評審要求、后續銜接等方面提出要求,對增量配(pei)電網規劃體系的建設和運(yun)行明確了政策導向,是(shi)開(kai)展增量配(pei)電網規劃工作(zuo)的行動指南。
明(ming)確了規劃工作責任主(zhu)體是地方能源(yuan)主(zhu)管部(bu)(bu)門(men)(men)。大部(bu)(bu)分(fen)增(zeng)量配電業務試(shi)點項目都有潛在業主(zhu)在前期階段做技術支持。增(zeng)量配電業務改革推進(jin)的(de)過程中,存在潛在業主(zhu)代(dai)替政府部(bu)(bu)門(men)(men)委(wei)托第三方咨詢機構(gou)開展規劃工作的(de)情況。
政府部門為電(dian)力(li)規劃的(de)責任主體(ti),電(dian)力(li)企(qi)業提(ti)出規劃建議(yi),是《電(dian)力(li)規劃管(guan)理辦(ban)法(fa)》(國能電(dian)力(li)〔2016〕139號)的(de)重要內(nei)容。為了(le)便于條(tiao)文制(zhi)定(ding),僅在(zai)文件中明確(que)了(le)省級及以(yi)上電(dian)力(li)規劃的(de)責任部門。政府主導電(dian)力(li)規劃從(cong)制(zhi)度上保(bao)障了(le)規劃以(yi)全社會視角來開展,確(que)保(bao)了(le)電(dian)力(li)規劃的(de)公正、客觀和科學性。
《通知(zhi)》進一(yi)步明(ming)確了增量配(pei)電網規劃(hua)(hua)工作的(de)責(ze)任主(zhu)體是地方(fang)能源主(zhu)管(guan)部門,園區(qu)管(guan)委(wei)會(hui)或區(qu)縣政(zheng)府(fu)可以代為(wei)履行,避免增量配(pei)電網規劃(hua)(hua)編制工作受委(wei)托主(zhu)體的(de)利益影響造成(cheng)規劃(hua)(hua)成(cheng)果的(de)偏差。同時,規劃(hua)(hua)責(ze)任主(zhu)體也(ye)要充分征求(qiu)、吸納相(xiang)關(guan)方(fang)的(de)合理化建議。
進一步明確了規(gui)(gui)劃(hua)的(de)(de)(de)邊界條件。政策(ce)要(yao)求(qiu)、規(gui)(gui)劃(hua)范圍、市(shi)政規(gui)(gui)劃(hua)和相(xiang)關電(dian)力系統(tong)現狀(zhuang)及(ji)規(gui)(gui)劃(hua)是增(zeng)量配(pei)電(dian)網規(gui)(gui)劃(hua)主要(yao)的(de)(de)(de)邊界條件。增(zeng)量配(pei)電(dian)業務改革推進的(de)(de)(de)過程中,存(cun)在(zai)依托常(chang)規(gui)(gui)機組(zu)建局域(yu)網等違反政策(ce)要(yao)求(qiu)情(qing)況(kuang),存(cun)在(zai)規(gui)(gui)劃(hua)范圍過小或過大的(de)(de)(de)情(qing)況(kuang),存(cun)在(zai)規(gui)(gui)劃(hua)編制單位對相(xiang)關電(dian)力系統(tong)現狀(zhuang)及(ji)規(gui)(gui)劃(hua)了解不足的(de)(de)(de)情(qing)況(kuang)。
依(yi)托(tuo)常規(gui)機(ji)組(zu)建局域網(wang),對于(yu)單個(ge)試點(dian)(dian)項(xiang)目獲(huo)取了(le)低廉的電(dian)(dian)價,但從全社會(hui)角(jiao)度來看削(xue)弱了(le)電(dian)(dian)網(wang)互聯帶(dai)來的電(dian)(dian)力系統(tong)效(xiao)率和(he)可靠性的提升,同時與(yu)其他工業園區(qu)(經濟技術開(kai)發區(qu))形成了(le)不公平競爭。規(gui)劃范圍過小(xiao),造(zao)成在規(gui)劃階段存(cun)量(liang)(liang)與(yu)增量(liang)(liang)總體情(qing)況摸不清,制(zhi)約了(le)規(gui)劃的科(ke)學(xue)性;規(gui)劃范圍過大(da),不利于(yu)后續(xu)工作的開(kai)展。規(gui)劃編制(zhi)單位對相關電(dian)(dian)力系統(tong)了(le)解不足,造(zao)成增量(liang)(liang)配電(dian)(dian)網(wang)與(yu)上級電(dian)(dian)網(wang)、周(zhou)邊(bian)電(dian)(dian)網(wang)不能(neng)有(you)效(xiao)銜接,造(zao)成試點(dian)(dian)項(xiang)目無(wu)法有(you)效(xiao)落(luo)地。
《通知(zhi)》進(jin)(jin)一步明(ming)確了(le)政(zheng)策不允許(xu)的(de)增(zeng)量配電網建設方式,不允許(xu)利(li)(li)用常規(gui)機(ji)組和自備機(ji)組搞不公平競爭,但(dan)允許(xu)符合政(zheng)策且納入(ru)規(gui)劃(hua)的(de)分布式電源(yuan)就近接入(ru),提高試(shi)點(dian)項目經濟效益;進(jin)(jin)一步明(ming)確了(le)園區類試(shi)點(dian)項目的(de)規(gui)劃(hua)范(fan)圍原則上(shang)按土地(di)利(li)(li)用規(gui)劃(hua)和城鄉建設規(gui)劃(hua)等(deng)上(shang)位規(gui)劃(hua)確定,以期規(gui)劃(hua)范(fan)圍有利(li)(li)于存量與增(zeng)量的(de)統籌;進(jin)(jin)一步明(ming)確了(le)規(gui)劃(hua)編制單(dan)位獲取(qu)相(xiang)關(guan)電力(li)系統現(xian)況及規(gui)劃(hua)的(de)渠(qu)道,電網企業有義務在規(gui)定的(de)時(shi)間內(nei)向(xiang)電力(li)規(gui)劃(hua)責(ze)(ze)任(ren)主體提供資料,并由電力(li)規(gui)劃(hua)責(ze)(ze)任(ren)主體轉給規(gui)劃(hua)編制單(dan)位。
進一步(bu)提出了規劃內容的(de)(de)深度要(yao)求(qiu)。從(cong)全社(she)會的(de)(de)視角來看,增量(liang)配(pei)(pei)(pei)電(dian)(dian)(dian)網(wang)(wang)(wang)和(he)(he)電(dian)(dian)(dian)網(wang)(wang)(wang)企業的(de)(de)公共電(dian)(dian)(dian)網(wang)(wang)(wang)均為滿(man)足電(dian)(dian)(dian)力需求(qiu)的(de)(de)基礎(chu)設施。增量(liang)配(pei)(pei)(pei)電(dian)(dian)(dian)業務改革推進過(guo)程中(zhong)(zhong),存在(zai)增量(liang)配(pei)(pei)(pei)電(dian)(dian)(dian)網(wang)(wang)(wang)新(xin)建(jian)變電(dian)(dian)(dian)站與容量(liang)尚(shang)未有(you)效利用的(de)(de)變電(dian)(dian)(dian)站距離較近(jin)甚(shen)至相鄰而(er)建(jian)的(de)(de)情(qing)況。上述情(qing)況很可能造成配(pei)(pei)(pei)電(dian)(dian)(dian)網(wang)(wang)(wang)無序發(fa)展和(he)(he)重復建(jian)設,易于造成公共資源(yuan)浪費(fei)和(he)(he)全社(she)會成本抬升。通過(guo)規劃階段的(de)(de)統(tong)籌(chou)謀劃和(he)(he)科學安(an)排,采取調整變電(dian)(dian)(dian)站選址和(he)(he)建(jian)設時序等規劃手段,避免不(bu)利情(qing)況發(fa)生,是規劃工作的(de)(de)題中(zhong)(zhong)應有(you)之意(yi)。
《通(tong)知(zhi)》提(ti)出增量配(pei)電網(wang)規(gui)(gui)劃(hua)編制階段(duan)要(yao)視(shi)實際需(xu)要(yao)設置重復(fu)辨(bian)識環節(jie),并以專(zhuan)門(men)章節(jie)的形式在規(gui)(gui)劃(hua)方案中體(ti)現(xian),是對傳統配(pei)電網(wang)規(gui)(gui)劃(hua)深(shen)度的調整和突(tu)破,適應現(xian)實需(xu)要(yao),體(ti)現(xian)了增量配(pei)電網(wang)的特點。
進一(yi)步提出了規(gui)(gui)劃評(ping)(ping)(ping)審(shen)(shen)階段的(de)組織(zhi)要求(qiu)。增量(liang)配(pei)電(dian)網(wang)規(gui)(gui)劃評(ping)(ping)(ping)審(shen)(shen)工(gong)作是把控增量(liang)配(pei)電(dian)網(wang)規(gui)(gui)劃質量(liang),為后續工(gong)作打牢基礎的(de)重(zhong)要環節。增量(liang)配(pei)電(dian)業務改(gai)革推進過程(cheng)中,部分項目(mu)評(ping)(ping)(ping)審(shen)(shen)工(gong)作在(zai)(zai)組織(zhi)形式(shi)和內容流程(cheng)上(shang)存(cun)在(zai)(zai)不規(gui)(gui)范、流于形式(shi)的(de)情況(kuang),甚(shen)至存(cun)在(zai)(zai)由規(gui)(gui)劃編制(zhi)單位(wei)、電(dian)網(wang)企業或其他潛在(zai)(zai)業主利益相(xiang)關方直(zhi)接擔任評(ping)(ping)(ping)審(shen)(shen)專家的(de)情況(kuang)。上(shang)述(shu)情況(kuang)下(xia),就會滋(zi)生“屁股決定腦袋”“打招(zhao)呼”等現象,不僅妨害評(ping)(ping)(ping)審(shen)(shen)主體的(de)中立性(xing)(xing),還會導(dao)致評(ping)(ping)(ping)審(shen)(shen)結(jie)論(lun)科學性(xing)(xing)和有(you)效性(xing)(xing)無法(fa)保障、評(ping)(ping)(ping)審(shen)(shen)流程(cheng)的(de)公正性(xing)(xing)受到(dao)妨害的(de)情況(kuang)。
《通(tong)知(zhi)》進(jin)一步提出了增量配電(dian)網規(gui)劃評審工作由省(sheng)級能源主管部門組織,委托具有資質(zhi)的(de)第三方(fang)咨詢機構開(kai)展,要求利益攸關方(fang)不(bu)得擔任評審專(zhuan)家,同時認(ren)真聽取政府部門、電(dian)網企(qi)業及(ji)其他(ta)潛業主的(de)意見,從制度上(shang)避免了上(shang)述情況的(de)發生。
進一步明確了規(gui)(gui)劃(hua)(hua)銜接(jie)的(de)后(hou)續工(gong)作要求。配電區域劃(hua)(hua)分(fen)和(he)增量(liang)配電網接(jie)入系(xi)統設(she)計是與規(gui)(gui)劃(hua)(hua)直(zhi)接(jie)相關的(de)后(hou)續工(gong)作。增量(liang)配電業務改革推進過程中,這兩(liang)項具體工(gong)作相對用時較長。
增量配(pei)電(dian)業務改革(ge)試點(dian)(dian)項目(mu)(mu)推進有(you)項目(mu)(mu)規(gui)劃(hua)(hua)、業主確定、項目(mu)(mu)核準、項目(mu)(mu)建(jian)設(she)(she)、公(gong)網接入、價格核定、許可申請和配(pei)電(dian)運營多個步驟,具體(ti)的(de)(de)順序和操作過程在實(shi)施上(shang)各地會(hui)有(you)所差異。配(pei)電(dian)區域劃(hua)(hua)分(fen)可以在項目(mu)(mu)規(gui)劃(hua)(hua)階段劃(hua)(hua)分(fen),也(ye)可以在業主確定后劃(hua)(hua)分(fen)。增量配(pei)電(dian)網接入系(xi)統設(she)(she)計是(shi)在項目(mu)(mu)核準之前(qian)完成。這兩項工作是(shi)后續工作的(de)(de)基礎,是(shi)推動試點(dian)(dian)項目(mu)(mu)的(de)(de)重(zhong)點(dian)(dian)和難(nan)點(dian)(dian)問題。
《通知》進一步(bu)明確(que)了配電(dian)區(qu)域(yu)劃(hua)分(fen)按照《增量(liang)配電(dian)業務配電(dian)區(qu)域(yu)劃(hua)分(fen)實(shi)施辦法(試(shi)行)》(發改能源(yuan)規(gui)〔2018〕424號)確(que)定;明確(que)了地方能源(yuan)主(zhu)管部門是(shi)接(jie)入系統(tong)(tong)設計的(de)(de)責(ze)任主(zhu)體,委托具有(you)資質的(de)(de)第三(san)方咨詢機構組織評審論證,充分(fen)聽(ting)取(qu)電(dian)網企業意(yi)見,協調確(que)定接(jie)入系統(tong)(tong)意(yi)見。
進一步規范了投資建設與運營
《通知(zhi)》第四部分圍繞解決(jue)增量配電業務建設和(he)運營存(cun)在的問題,提出十三條政策措施,從(cong)三個層次展(zhan)開(kai)。
立足解(jie)決(jue)共性問題。目(mu)(mu)前三批320個試(shi)點大部分處于(yu)規劃(hua)(hua)編制(zhi)、業主選擇、許可證(zheng)辦(ban)(ban)理等階段(duan),投產運營項目(mu)(mu)偏少(shao)。相(xiang)關部門在(zai)(zai)組織(zhi)電力(li)規劃(hua)(hua)設計總院(yuan)等咨詢機構全面摸底(di)調研發現,試(shi)點項目(mu)(mu)在(zai)(zai)建設、運營環(huan)節存在(zai)(zai)的問題相(xiang)似,主要集(ji)中在(zai)(zai)資產處置、公(gong)網(wang)接入、電力(li)業務許可證(zheng)辦(ban)(ban)理、公(gong)平競爭(zheng)等方面。
《通(tong)知》第四(si)部分針(zhen)對這些共性問(wen)題,一是(shi)(shi)進(jin)(jin)一步(bu)(bu)重申了規劃范圍內存量(liang)(liang)(liang)資產處置方(fang)式(shi),鼓勵(li)存量(liang)(liang)(liang)資產通(tong)過資產入股、出(chu)(chu)售、產權(quan)置換等(deng)方(fang)式(shi)參(can)與(yu)增量(liang)(liang)(liang)配(pei)(pei)電(dian)(dian)(dian)(dian)網(wang)投資、建(jian)設和運營(ying);二是(shi)(shi)進(jin)(jin)一步(bu)(bu)要(yao)求地方(fang)有(you)關部門優(you)化項目核準程序(xu),提高審核效率,加快(kuai)增量(liang)(liang)(liang)配(pei)(pei)電(dian)(dian)(dian)(dian)網(wang)建(jian)設核準,要(yao)求國家能源局資質中(zhong)心、派出(chu)(chu)能源監管機構進(jin)(jin)一步(bu)(bu)簡化增量(liang)(liang)(liang)配(pei)(pei)電(dian)(dian)(dian)(dian)業務(wu)電(dian)(dian)(dian)(dian)力業務(wu)許可證申領程序(xu);三是(shi)(shi)明確和強調增量(liang)(liang)(liang)配(pei)(pei)電(dian)(dian)(dian)(dian)網(wang)與(yu)大電(dian)(dian)(dian)(dian)網(wang)是(shi)(shi)網(wang)對網(wang)關系,擁有(you)與(yu)電(dian)(dian)(dian)(dian)網(wang)企(qi)業在(zai)互(hu)聯(lian)互(hu)通(tong)、建(jian)設運營(ying)、參(can)與(yu)電(dian)(dian)(dian)(dian)力市場(chang)、保底(di)供電(dian)(dian)(dian)(dian)等(deng)方(fang)面同(tong)等(deng)的權(quan)利和義(yi)務(wu),進(jin)(jin)一步(bu)(bu)破除增量(liang)(liang)(liang)配(pei)(pei)電(dian)(dian)(dian)(dian)網(wang)接入電(dian)(dian)(dian)(dian)網(wang)的體制藩籬;四(si)是(shi)(shi)建(jian)立國家和地方(fang)政府有(you)關部門的互(hu)動、聯(lian)席(xi)工作(zuo)機制,常(chang)態(tai)化開(kai)展(zhan)(zhan)對增量(liang)(liang)(liang)配(pei)(pei)電(dian)(dian)(dian)(dian)業務(wu)進(jin)(jin)展(zhan)(zhan)緩慢和問(wen)題突出(chu)(chu)地區進(jin)(jin)行通(tong)報、約談,不斷(duan)破解改(gai)革推(tui)進(jin)(jin)中(zhong)的難點(dian)問(wen)題。
切實保障電(dian)力(li)安全穩(wen)定供(gong)(gong)應(ying)(ying)。避免供(gong)(gong)電(dian)事故(gu)是增(zeng)(zeng)量(liang)配(pei)(pei)電(dian)改(gai)革的(de)基(ji)本遵循,也是關(guan)系改(gai)革能否行(xing)(xing)穩(wen)致遠(yuan)的(de)關(guan)鍵一環。《通知》第四部(bu)分,一是建(jian)(jian)立了增(zeng)(zeng)量(liang)配(pei)(pei)電(dian)網(wang)建(jian)(jian)設(she)(she)過渡(du)期電(dian)力(li)保障供(gong)(gong)應(ying)(ying)方案,允許由(you)電(dian)網(wang)企業(ye)(ye)(ye)等先行(xing)(xing)建(jian)(jian)設(she)(she)運行(xing)(xing)配(pei)(pei)電(dian)設(she)(she)施(shi),待增(zeng)(zeng)量(liang)配(pei)(pei)電(dian)項目(mu)具備供(gong)(gong)電(dian)能力(li)后,可(ke)選擇折價入股或(huo)轉讓等方式進(jin)行(xing)(xing)處置;二是建(jian)(jian)立增(zeng)(zeng)量(liang)配(pei)(pei)電(dian)業(ye)(ye)(ye)務試(shi)點項目(mu)和項目(mu)業(ye)(ye)(ye)主(zhu)(zhu)的(de)退出機(ji)制,經地(di)方能源主(zhu)(zhu)管(guan)部(bu)門會同派出能源監(jian)管(guan)機(ji)構評(ping)估認定不(bu)再具備試(shi)點條件(jian)的(de),報(bao)國家(jia)發改(gai)委(wei)、國家(jia)能源局同意(yi)后可(ke)取消(xiao)項目(mu)試(shi)點資格(ge)(ge)。對(dui)于項目(mu)業(ye)(ye)(ye)主(zhu)(zhu)拖延建(jian)(jian)設(she)(she)、拒不(bu)履行(xing)(xing)建(jian)(jian)設(she)(she)承諾或(huo)運營水(shui)平達不(bu)到投標要求,造(zao)成無法(fa)滿(man)足(zu)區內(nei)用(yong)戶用(yong)電(dian)需求的(de),應(ying)(ying)視情(qing)況依(yi)法(fa)依(yi)規取消(xiao)項目(mu)業(ye)(ye)(ye)主(zhu)(zhu)資格(ge)(ge),并(bing)重新招標確定項目(mu)業(ye)(ye)(ye)主(zhu)(zhu)。過渡(du)期間可(ke)由(you)電(dian)網(wang)企業(ye)(ye)(ye)接收并(bing)提供(gong)(gong)保底供(gong)(gong)電(dian)服務,不(bu)得因增(zeng)(zeng)量(liang)配(pei)(pei)電(dian)網(wang)業(ye)(ye)(ye)主(zhu)(zhu)更換影響電(dian)力(li)安全、可(ke)靠供(gong)(gong)應(ying)(ying)。三是加強(qiang)對(dui)增(zeng)(zeng)量(liang)配(pei)(pei)電(dian)項目(mu)業(ye)(ye)(ye)主(zhu)(zhu)履約行(xing)(xing)為管(guan)理,建(jian)(jian)立增(zeng)(zeng)量(liang)配(pei)(pei)電(dian)企業(ye)(ye)(ye)失信“黑名單”。

瞄準問題靶向施策,凝聚共(gong)識砥礪前(qian)行。《通知》的(de)(de)(de)(de)下發,為各(ge)方開展增(zeng)量配(pei)電業(ye)務改(gai)革(ge)(ge)提供了規范(fan)指引,根本(ben)目的(de)(de)(de)(de)是加快推進(jin)試點(dian)落地生根,取得(de)實效。《通知》的(de)(de)(de)(de)“二次點(dian)火”的(de)(de)(de)(de)作用和“轉折點(dian)”的(de)(de)(de)(de)意(yi)義,值得(de)我們共(gong)同(tong)期待。筆者相信,隨(sui)著政策體系的(de)(de)(de)(de)不(bu)斷完善、第(di)四批(pi)試點(dian)項目的(de)(de)(de)(de)申報(bao)批(pi)復(fu)、改(gai)革(ge)(ge)實踐的(de)(de)(de)(de)深入推進(jin)、各(ge)方的(de)(de)(de)(de)共(gong)識逐步(bu)匯聚,增(zeng)量配(pei)電業(ye)務改(gai)革(ge)(ge)的(de)(de)(de)(de)新局面一定會(hui)加快形成(cheng)。
