國務院:實現工程建設項目審批“四統一”

日前,國務院辦(ban)公廳印發(fa)《關于全面開(kai)展工程建(jian)設項目審批(pi)制(zhi)度(du)改革的(de)實施意(yi)見》(以下(xia)簡稱《意(yi)見》)。


《意(yi)見(jian)》指出,要以習(xi)近平新時代中國特(te)色社(she)會主(zhu)義思想(xiang)為(wei)(wei)(wei)指導(dao),堅(jian)持以人(ren)民為(wei)(wei)(wei)中心,牢固樹立新發展(zhan)理(li)念,以推進政(zheng)府治理(li)體(ti)系(xi)和治理(li)能力現代化為(wei)(wei)(wei)目(mu)(mu)標,以更(geng)好更(geng)快方便企業和群(qun)眾辦(ban)事為(wei)(wei)(wei)導(dao)向,加(jia)大轉變政(zheng)府職能和簡政(zheng)放(fang)權力度(du),全(quan)面開展(zhan)工程建設(she)項目(mu)(mu)審批制(zhi)度(du)改革(ge)。


《意見》提出(chu),對工程(cheng)(cheng)建(jian)(jian)(jian)設(she)(she)(she)項(xiang)目(mu)審(shen)批(pi)制(zhi)度(du)實施全流程(cheng)(cheng)、全覆蓋改(gai)(gai)革(ge)。2019年(nian)上(shang)半年(nian),全國工程(cheng)(cheng)建(jian)(jian)(jian)設(she)(she)(she)項(xiang)目(mu)審(shen)批(pi)時間壓(ya)縮至120個工作日以內,省(自治區)和地(di)級及以上(shang)城市初步建(jian)(jian)(jian)成(cheng)工程(cheng)(cheng)建(jian)(jian)(jian)設(she)(she)(she)項(xiang)目(mu)審(shen)批(pi)制(zhi)度(du)框架和信息數(shu)據平臺;到2019年(nian)底,工程(cheng)(cheng)建(jian)(jian)(jian)設(she)(she)(she)項(xiang)目(mu)審(shen)批(pi)管理系統(tong)(tong)與相關系統(tong)(tong)平臺互聯互通;試點地(di)區繼續(xu)深化改(gai)(gai)革(ge),加大(da)改(gai)(gai)革(ge)創(chuang)新力度(du),提高審(shen)批(pi)效能。到2020年(nian)底,基本建(jian)(jian)(jian)成(cheng)全國統(tong)(tong)一的工程(cheng)(cheng)建(jian)(jian)(jian)設(she)(she)(she)項(xiang)目(mu)審(shen)批(pi)和管理體系。


《意見》提出,要實現(xian)工程建設項目審批“四統一”。


一(yi)(yi)(yi)(yi)是(shi)統(tong)一(yi)(yi)(yi)(yi)審(shen)(shen)批(pi)(pi)流程(cheng)(cheng)(cheng)。精(jing)簡審(shen)(shen)批(pi)(pi)環(huan)節,逐步形成(cheng)全(quan)國統(tong)一(yi)(yi)(yi)(yi)的(de)(de)審(shen)(shen)批(pi)(pi)事項(xiang)清單。合理劃分審(shen)(shen)批(pi)(pi)階(jie)段,每個(ge)審(shen)(shen)批(pi)(pi)階(jie)段實(shi)行“一(yi)(yi)(yi)(yi)家牽頭、并聯(lian)(lian)審(shen)(shen)批(pi)(pi)、限(xian)時辦結”。制(zhi)定全(quan)國統(tong)一(yi)(yi)(yi)(yi)的(de)(de)工程(cheng)(cheng)(cheng)建(jian)設(she)項(xiang)目審(shen)(shen)批(pi)(pi)流程(cheng)(cheng)(cheng)圖示范文本,地方(fang)進一(yi)(yi)(yi)(yi)步細化審(shen)(shen)批(pi)(pi)流程(cheng)(cheng)(cheng)。實(shi)行聯(lian)(lian)合審(shen)(shen)圖和(he)聯(lian)(lian)合驗收,推行區域評(ping)估和(he)告知承諾(nuo)制(zhi)。


二是統(tong)(tong)一信(xin)息數據平臺。地(di)級及以上地(di)方人(ren)民政(zheng)府(fu)要按照“橫向(xiang)(xiang)到邊、縱向(xiang)(xiang)到底”的(de)原則,整(zheng)合(he)建(jian)(jian)設(she)覆蓋地(di)方各有(you)關(guan)部門和(he)區、縣(xian)的(de)工(gong)程(cheng)建(jian)(jian)設(she)項目(mu)審(shen)(shen)批管(guan)理系統(tong)(tong),與(yu)國(guo)家(jia)相關(guan)系統(tong)(tong)對接。省級工(gong)程(cheng)建(jian)(jian)設(she)項目(mu)審(shen)(shen)批管(guan)理系統(tong)(tong)要與(yu)國(guo)家(jia)和(he)本地(di)區各城(cheng)市相關(guan)系統(tong)(tong)實現(xian)審(shen)(shen)批數據實時共(gong)享(xiang)。


三(san)是統(tong)一審(shen)批管理體系。整合(he)(he)各(ge)類(lei)規劃,構建(jian)“多(duo)規合(he)(he)一”的“一張藍圖”,統(tong)籌項目實施。設立工程建(jian)設項目審(shen)批綜合(he)(he)服務(wu)窗口,實現(xian)“一個窗口”提供綜合(he)(he)服務(wu)。各(ge)審(shen)批階段實行“一份辦事指(zhi)南(nan),一張申(shen)請表單(dan),一套申(shen)報(bao)材(cai)料,完成多(duo)項審(shen)批”的運作模(mo)式(shi),整合(he)(he)申(shen)報(bao)材(cai)料。建(jian)立健全審(shen)批配(pei)套制度,“一套機制”規范審(shen)批運行。


四是統一(yi)監(jian)管(guan)方式(shi)。建(jian)立(li)以“雙隨(sui)機(ji)(ji)、一(yi)公(gong)開”監(jian)管(guan)為(wei)(wei)基本手段(duan),以重點監(jian)管(guan)為(wei)(wei)補充,以信用監(jian)管(guan)為(wei)(wei)基礎的新型監(jian)管(guan)機(ji)(ji)制。加強信用體系建(jian)設,構建(jian)“一(yi)處(chu)失信、處(chu)處(chu)受限”的聯合懲(cheng)戒機(ji)(ji)制。建(jian)立(li)健全中(zhong)介服務和市政公(gong)用服務管(guan)理(li)制度,規范中(zhong)介和市政公(gong)用服務。


《意見》要求,各有關部門要加強協作(zuo)(zuo)、密切(qie)配合。各地方人民政府要承擔改(gai)(gai)革(ge)(ge)主體責任,制定改(gai)(gai)革(ge)(ge)時間表(biao)、路線(xian)圖,確保按(an)時保質完成改(gai)(gai)革(ge)(ge)任務。對于工(gong)作(zuo)(zuo)推(tui)進(jin)不力、影(ying)響(xiang)工(gong)程建設項目審批制度改(gai)(gai)革(ge)(ge)進(jin)程,特別是未按(an)時完成階段性工(gong)作(zuo)(zuo)目標的,要依法(fa)依規嚴肅(su)問責。

各省、自治(zhi)區、直轄市人民政府(fu),國(guo)務(wu)院各部(bu)委、各直屬機構(gou):


工(gong)程(cheng)(cheng)建設(she)項(xiang)目審批(pi)(pi)制(zhi)(zhi)度(du)改革(ge)是黨中央(yang)、國務院在(zai)新形勢下(xia)作出(chu)的(de)重大決(jue)策,是推進政府職能轉變和深化(hua)“放管(guan)(guan)服”改革(ge)、優化(hua)營商環境(jing)的(de)重要內容。2018年5月工(gong)程(cheng)(cheng)建設(she)項(xiang)目審批(pi)(pi)制(zhi)(zhi)度(du)改革(ge)試點開(kai)展(zhan)以來,試點地(di)區按照國務院部署,對工(gong)程(cheng)(cheng)建設(she)項(xiang)目審批(pi)(pi)制(zhi)(zhi)度(du)實施了全流(liu)程(cheng)(cheng)、全覆蓋改革(ge),基本(ben)形成統一的(de)審批(pi)(pi)流(liu)程(cheng)(cheng)、統一的(de)信息(xi)數據平(ping)臺、統一的(de)審批(pi)(pi)管(guan)(guan)理體系和統一的(de)監管(guan)(guan)方式。經國務院同意,現就全面開(kai)展(zhan)工(gong)程(cheng)(cheng)建設(she)項(xiang)目審批(pi)(pi)制(zhi)(zhi)度(du)改革(ge)提(ti)出(chu)以下(xia)意見。


一、總體要求


(一(yi))指導思想。以(yi)習近平新(xin)時代中(zhong)國(guo)特(te)色社會主義思想為指導,深入貫(guan)徹黨的十九大(da)和十九屆(jie)二中(zhong)、三中(zhong)全會精(jing)神(shen),堅持以(yi)人民為中(zhong)心,牢固(gu)樹(shu)立(li)新(xin)發展(zhan)理念,以(yi)推進政府治理體系(xi)和治理能(neng)力(li)現代化為目標,以(yi)更好更快方(fang)便企(qi)業和群(qun)眾辦(ban)事為導向,加(jia)大(da)轉(zhuan)變政府職能(neng)和簡政放權力(li)度(du),全面開展(zhan)工程建設項(xiang)目審(shen)批(pi)制度(du)改革,統(tong)(tong)一(yi)審(shen)批(pi)流(liu)程,統(tong)(tong)一(yi)信息數據(ju)平臺,統(tong)(tong)一(yi)審(shen)批(pi)管(guan)理體系(xi),統(tong)(tong)一(yi)監(jian)管(guan)方(fang)式,實現工程建設項(xiang)目審(shen)批(pi)“四統(tong)(tong)一(yi)”。


(二)改(gai)(gai)(gai)革(ge)內容(rong)。對工(gong)程(cheng)(cheng)(cheng)(cheng)建設(she)項(xiang)(xiang)目(mu)審(shen)批(pi)制度(du)實施全流(liu)程(cheng)(cheng)(cheng)(cheng)、全覆(fu)蓋(gai)改(gai)(gai)(gai)革(ge)。改(gai)(gai)(gai)革(ge)覆(fu)蓋(gai)工(gong)程(cheng)(cheng)(cheng)(cheng)建設(she)項(xiang)(xiang)目(mu)審(shen)批(pi)全過(guo)程(cheng)(cheng)(cheng)(cheng)(包括(kuo)從立項(xiang)(xiang)到(dao)竣(jun)工(gong)驗收和(he)公共(gong)設(she)施接入服(fu)(fu)務);主(zhu)要是房屋建筑和(he)城市基礎設(she)施等(deng)工(gong)程(cheng)(cheng)(cheng)(cheng),不包括(kuo)特殊工(gong)程(cheng)(cheng)(cheng)(cheng)和(he)交通、水利、能源(yuan)等(deng)領域的重大工(gong)程(cheng)(cheng)(cheng)(cheng);覆(fu)蓋(gai)行政許(xu)可等(deng)審(shen)批(pi)事(shi)項(xiang)(xiang)和(he)技術審(shen)查(cha)、中介服(fu)(fu)務、市政公用服(fu)(fu)務以及備案等(deng)其他類型事(shi)項(xiang)(xiang),推(tui)動流(liu)程(cheng)(cheng)(cheng)(cheng)優化和(he)標準(zhun)化。


(三)主要(yao)目(mu)(mu)(mu)標。2019年上半年,全(quan)國(guo)工程(cheng)建(jian)(jian)設項(xiang)(xiang)目(mu)(mu)(mu)審(shen)(shen)批時間(jian)壓縮(suo)至120個工作日以內,省(自治區(qu))和(he)(he)(he)地級及以上城(cheng)市初步建(jian)(jian)成工程(cheng)建(jian)(jian)設項(xiang)(xiang)目(mu)(mu)(mu)審(shen)(shen)批制度(du)框(kuang)架和(he)(he)(he)信(xin)息數據平臺(tai);到(dao)2019年底,工程(cheng)建(jian)(jian)設項(xiang)(xiang)目(mu)(mu)(mu)審(shen)(shen)批管理系(xi)(xi)統與相關系(xi)(xi)統平臺(tai)互(hu)聯互(hu)通(tong);試(shi)點地區(qu)繼續深化(hua)改(gai)革,加大改(gai)革創(chuang)新力度(du),進一步精(jing)簡審(shen)(shen)批環節和(he)(he)(he)事項(xiang)(xiang),減少審(shen)(shen)批階段(duan),壓減審(shen)(shen)批時間(jian),加強輔導服務,提高(gao)審(shen)(shen)批效能。到(dao)2020年底,基本(ben)建(jian)(jian)成全(quan)國(guo)統一的工程(cheng)建(jian)(jian)設項(xiang)(xiang)目(mu)(mu)(mu)審(shen)(shen)批和(he)(he)(he)管理體系(xi)(xi)。


二、統一審批流程


(四)精(jing)簡審(shen)(shen)批(pi)(pi)(pi)環節。精(jing)減(jian)審(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)項(xiang)和(he)條件(jian),取消不(bu)合(he)(he)法、不(bu)合(he)(he)理(li)(li)(li)、不(bu)必要(yao)的(de)審(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)項(xiang),減(jian)少保留事(shi)(shi)項(xiang)的(de)前(qian)置條件(jian)。下放審(shen)(shen)批(pi)(pi)(pi)權限,按(an)照方便企業和(he)群眾辦(ban)事(shi)(shi)的(de)原則(ze),對(dui)下級機關有能力(li)承接的(de)審(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)項(xiang),下放或(huo)(huo)委托下級機關審(shen)(shen)批(pi)(pi)(pi)。合(he)(he)并審(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)項(xiang),對(dui)由同一(yi)部門(men)實(shi)施(shi)(shi)的(de)管理(li)(li)(li)內(nei)容相近或(huo)(huo)者屬(shu)于(yu)同一(yi)辦(ban)理(li)(li)(li)階段的(de)多(duo)個審(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)項(xiang),整(zheng)合(he)(he)為一(yi)個審(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)項(xiang)。轉變管理(li)(li)(li)方式,對(dui)能夠用(yong)征求(qiu)相關部門(men)意見方式替代的(de)審(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)項(xiang),調整(zheng)為政府內(nei)部協作事(shi)(shi)項(xiang)。調整(zheng)審(shen)(shen)批(pi)(pi)(pi)時序,地震安全性(xing)評價在(zai)工(gong)(gong)程設(she)(she)(she)計(ji)前(qian)完成即(ji)可,環境影(ying)響評價、節能評價等(deng)(deng)評估評價和(he)取水(shui)許(xu)可等(deng)(deng)事(shi)(shi)項(xiang)在(zai)開(kai)工(gong)(gong)前(qian)完成即(ji)可;可以將用(yong)地預審(shen)(shen)意見作為使用(yong)土地證(zheng)明(ming)文件(jian)申請(qing)辦(ban)理(li)(li)(li)建設(she)(she)(she)工(gong)(gong)程規劃許(xu)可證(zheng);將供水(shui)、供電(dian)、燃氣、熱力(li)、排水(shui)、通信等(deng)(deng)市(shi)政公用(yong)基(ji)礎設(she)(she)(she)施(shi)(shi)報裝(zhuang)提前(qian)到開(kai)工(gong)(gong)前(qian)辦(ban)理(li)(li)(li),在(zai)工(gong)(gong)程施(shi)(shi)工(gong)(gong)階段完成相關設(she)(she)(she)施(shi)(shi)建設(she)(she)(she),竣工(gong)(gong)驗收(shou)后直(zhi)接辦(ban)理(li)(li)(li)接入事(shi)(shi)宜。試點地區要(yao)進一(yi)步精(jing)簡審(shen)(shen)批(pi)(pi)(pi)環節,在(zai)加快探索取消施(shi)(shi)工(gong)(gong)圖(tu)審(shen)(shen)查(或(huo)(huo)縮(suo)小審(shen)(shen)查范圍)、實(shi)行告知承諾制(zhi)(zhi)(zhi)和(he)設(she)(she)(she)計(ji)人員終身負責制(zhi)(zhi)(zhi)等(deng)(deng)方面,盡快形(xing)成可復制(zhi)(zhi)(zhi)可推廣(guang)的(de)經(jing)驗。


(五)規范審(shen)批(pi)(pi)(pi)事(shi)項(xiang)。各地(di)要按照國(guo)務院(yuan)統一要求,對本(ben)地(di)區(qu)工(gong)程建(jian)設(she)項(xiang)目(mu)審(shen)批(pi)(pi)(pi)事(shi)項(xiang)進(jin)行全面清(qing)理,統一審(shen)批(pi)(pi)(pi)事(shi)項(xiang)和法律(lv)依據,逐(zhu)步(bu)形成(cheng)全國(guo)統一的(de)審(shen)批(pi)(pi)(pi)事(shi)項(xiang)名稱、申請材(cai)料(liao)和審(shen)批(pi)(pi)(pi)時限。要本(ben)著(zhu)合法、精簡(jian)、效能的(de)原(yuan)則(ze),制定國(guo)家、省(自治區(qu))和地(di)級(ji)及以(yi)上(shang)(shang)城市工(gong)程建(jian)設(she)項(xiang)目(mu)審(shen)批(pi)(pi)(pi)事(shi)項(xiang)清(qing)單,明確(que)各項(xiang)審(shen)批(pi)(pi)(pi)事(shi)項(xiang)的(de)適用范圍和前置條件,并實行動(dong)態管理。下級(ji)政府(fu)制定的(de)審(shen)批(pi)(pi)(pi)事(shi)項(xiang)清(qing)單原(yuan)則(ze)上(shang)(shang)要與上(shang)(shang)級(ji)政府(fu)審(shen)批(pi)(pi)(pi)事(shi)項(xiang)清(qing)單一致,超出上(shang)(shang)級(ji)政府(fu)審(shen)批(pi)(pi)(pi)事(shi)項(xiang)清(qing)單范圍的(de),要報上(shang)(shang)級(ji)機關備(bei)案,并說(shuo)明理由。


(六)合理劃(hua)分審(shen)(shen)批(pi)階(jie)(jie)(jie)段(duan)(duan)。將工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建(jian)設(she)項(xiang)目審(shen)(shen)批(pi)流(liu)程(cheng)(cheng)(cheng)主(zhu)(zhu)(zhu)要(yao)劃(hua)分為立項(xiang)用地規劃(hua)許(xu)(xu)可(ke)(ke)、工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建(jian)設(she)許(xu)(xu)可(ke)(ke)、施工(gong)(gong)(gong)許(xu)(xu)可(ke)(ke)、竣工(gong)(gong)(gong)驗收(shou)(shou)(shou)四(si)個階(jie)(jie)(jie)段(duan)(duan)。其中(zhong),立項(xiang)用地規劃(hua)許(xu)(xu)可(ke)(ke)階(jie)(jie)(jie)段(duan)(duan)主(zhu)(zhu)(zhu)要(yao)包(bao)(bao)(bao)括(kuo)項(xiang)目審(shen)(shen)批(pi)核準(zhun)、選(xuan)址(zhi)意(yi)見(jian)書(shu)核發、用地預審(shen)(shen)、用地規劃(hua)許(xu)(xu)可(ke)(ke)證(zheng)核發等(deng)。工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建(jian)設(she)許(xu)(xu)可(ke)(ke)階(jie)(jie)(jie)段(duan)(duan)主(zhu)(zhu)(zhu)要(yao)包(bao)(bao)(bao)括(kuo)設(she)計方案(an)(an)審(shen)(shen)查(cha)、建(jian)設(she)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)規劃(hua)許(xu)(xu)可(ke)(ke)證(zheng)核發等(deng)。施工(gong)(gong)(gong)許(xu)(xu)可(ke)(ke)階(jie)(jie)(jie)段(duan)(duan)主(zhu)(zhu)(zhu)要(yao)包(bao)(bao)(bao)括(kuo)設(she)計審(shen)(shen)核確認、施工(gong)(gong)(gong)許(xu)(xu)可(ke)(ke)證(zheng)核發等(deng)。竣工(gong)(gong)(gong)驗收(shou)(shou)(shou)階(jie)(jie)(jie)段(duan)(duan)主(zhu)(zhu)(zhu)要(yao)包(bao)(bao)(bao)括(kuo)規劃(hua)、土地、消防、人防、檔案(an)(an)等(deng)驗收(shou)(shou)(shou)及竣工(gong)(gong)(gong)驗收(shou)(shou)(shou)備(bei)案(an)(an)等(deng)。其他行政(zheng)許(xu)(xu)可(ke)(ke)、強(qiang)制性評估、中(zhong)介服(fu)務、市(shi)政(zheng)公用服(fu)務以及備(bei)案(an)(an)等(deng)事項(xiang)納入相(xiang)關(guan)(guan)階(jie)(jie)(jie)段(duan)(duan)辦理或(huo)與相(xiang)關(guan)(guan)階(jie)(jie)(jie)段(duan)(duan)并(bing)行推進。每個審(shen)(shen)批(pi)階(jie)(jie)(jie)段(duan)(duan)確定一(yi)家(jia)牽頭(tou)部門,實行“一(yi)家(jia)牽頭(tou)、并(bing)聯審(shen)(shen)批(pi)、限(xian)時辦結”,由牽頭(tou)部門組織協調相(xiang)關(guan)(guan)部門嚴格按照限(xian)定時間(jian)完成審(shen)(shen)批(pi)。


(七)分(fen)類(lei)(lei)(lei)制(zhi)定審(shen)(shen)批(pi)流(liu)程(cheng)(cheng)(cheng)。制(zhi)定全國(guo)統一(yi)的工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建(jian)(jian)設(she)(she)項目審(shen)(shen)批(pi)流(liu)程(cheng)(cheng)(cheng)圖示范(fan)文本。地(di)級及以上地(di)方(fang)(fang)人(ren)民政府要根據示范(fan)文本,分(fen)別制(zhi)定政府投資、社(she)會(hui)投資等不同類(lei)(lei)(lei)型(xing)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)的審(shen)(shen)批(pi)流(liu)程(cheng)(cheng)(cheng)圖;同時可結合(he)實際(ji),根據工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建(jian)(jian)設(she)(she)項目類(lei)(lei)(lei)型(xing)、投資類(lei)(lei)(lei)別、規模(mo)大小(xiao)等,進一(yi)步梳理合(he)并審(shen)(shen)批(pi)流(liu)程(cheng)(cheng)(cheng)。簡化社(she)會(hui)投資的中(zhong)小(xiao)型(xing)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建(jian)(jian)設(she)(she)項目審(shen)(shen)批(pi),對(dui)于帶方(fang)(fang)案出讓土地(di)的項目,不再(zai)對(dui)設(she)(she)計方(fang)(fang)案進行審(shen)(shen)核,將工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建(jian)(jian)設(she)(she)許可和施工(gong)(gong)(gong)許可合(he)并為一(yi)個(ge)階(jie)(jie)段(duan)(duan)。試點地(di)區要進一(yi)步加大改革(ge)力(li)度,也可以在(zai)其他工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建(jian)(jian)設(she)(she)項目中(zhong)探索將工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建(jian)(jian)設(she)(she)許可和施工(gong)(gong)(gong)許可合(he)并為一(yi)個(ge)階(jie)(jie)段(duan)(duan)。


(八(ba))實行(xing)聯(lian)合(he)(he)(he)審(shen)(shen)圖(tu)(tu)和聯(lian)合(he)(he)(he)驗(yan)(yan)收(shou)(shou)。制定施工圖(tu)(tu)設計(ji)文件(jian)聯(lian)合(he)(he)(he)審(shen)(shen)查(cha)(cha)和聯(lian)合(he)(he)(he)竣工驗(yan)(yan)收(shou)(shou)管理辦法。將消防、人(ren)防、技(ji)(ji)防等技(ji)(ji)術審(shen)(shen)查(cha)(cha)并入施工圖(tu)(tu)設計(ji)文件(jian)審(shen)(shen)查(cha)(cha),相關部門不再進行(xing)技(ji)(ji)術審(shen)(shen)查(cha)(cha)。實行(xing)規劃、土地、消防、人(ren)防、檔案等事項限時聯(lian)合(he)(he)(he)驗(yan)(yan)收(shou)(shou),統一竣工驗(yan)(yan)收(shou)(shou)圖(tu)(tu)紙和驗(yan)(yan)收(shou)(shou)標(biao)準(zhun),統一出具(ju)驗(yan)(yan)收(shou)(shou)意見。對于驗(yan)(yan)收(shou)(shou)涉及的測繪工作,實行(xing)“一次(ci)委托、聯(lian)合(he)(he)(he)測繪、成果共(gong)享(xiang)”。


(九)推行(xing)區域(yu)評(ping)(ping)(ping)估(gu)。在(zai)各(ge)類開發區、工業園區、新區和其他有條(tiao)件的(de)(de)區域(yu),推行(xing)由政府統一組(zu)織對壓(ya)覆重(zhong)要礦產資源、環境影響評(ping)(ping)(ping)價(jia)(jia)、節(jie)能評(ping)(ping)(ping)價(jia)(jia)、地質災害危險性評(ping)(ping)(ping)估(gu)、地震安全性評(ping)(ping)(ping)價(jia)(jia)、水(shui)資源論證等評(ping)(ping)(ping)估(gu)評(ping)(ping)(ping)價(jia)(jia)事項(xiang)實行(xing)區域(yu)評(ping)(ping)(ping)估(gu)。實行(xing)區域(yu)評(ping)(ping)(ping)估(gu)的(de)(de),政府相關(guan)部門應在(zai)土地出(chu)讓或劃撥前,告知建設(she)單位相關(guan)建設(she)要求。


(十)推(tui)行(xing)(xing)告知(zhi)(zhi)承(cheng)(cheng)諾制(zhi)。對(dui)通過事(shi)中事(shi)后監管能(neng)夠糾正(zheng)不符合審(shen)(shen)批(pi)條(tiao)件的(de)行(xing)(xing)為且不會產(chan)生嚴重后果的(de)審(shen)(shen)批(pi)事(shi)項,實行(xing)(xing)告知(zhi)(zhi)承(cheng)(cheng)諾制(zhi)。公布實行(xing)(xing)告知(zhi)(zhi)承(cheng)(cheng)諾制(zhi)的(de)工程建設項目審(shen)(shen)批(pi)事(shi)項清單(dan)及具體要求(qiu),申請(qing)(qing)人按(an)照(zhao)要求(qiu)作(zuo)出書面承(cheng)(cheng)諾的(de),審(shen)(shen)批(pi)部門可以根據申請(qing)(qing)人信用(yong)等情況直接作(zuo)出審(shen)(shen)批(pi)決定。對(dui)已經實施區域評估范(fan)圍(wei)內的(de)工程建設項目,相應的(de)審(shen)(shen)批(pi)事(shi)項實行(xing)(xing)告知(zhi)(zhi)承(cheng)(cheng)諾制(zhi)。


三、統一信息數據平臺

四、統一審批管理體系


(十(shi)二)“一(yi)(yi)張藍圖”統(tong)籌(chou)(chou)項(xiang)(xiang)目實施。統(tong)籌(chou)(chou)整合(he)各類規劃,劃定(ding)各類控制(zhi)線,構(gou)建(jian)(jian)“多(duo)規合(he)一(yi)(yi)”的“一(yi)(yi)張藍圖”。依托工(gong)(gong)程建(jian)(jian)設(she)項(xiang)(xiang)目審(shen)批(pi)管理系統(tong),加(jia)強“多(duo)規合(he)一(yi)(yi)”業務協(xie)同,統(tong)籌(chou)(chou)協(xie)調各部門對工(gong)(gong)程建(jian)(jian)設(she)項(xiang)(xiang)目提出建(jian)(jian)設(she)條件以及需要(yao)開展的評估(gu)評價事項(xiang)(xiang)等要(yao)求,為項(xiang)(xiang)目建(jian)(jian)設(she)單位(wei)落實建(jian)(jian)設(she)條件、相關部門加(jia)強監督管理提供依據(ju),加(jia)速項(xiang)(xiang)目前期策劃生成,簡化項(xiang)(xiang)目審(shen)批(pi)或核準(zhun)手續。


(十三)“一個窗(chuang)(chuang)口(kou)(kou)(kou)”提供綜(zong)合(he)服務。縣級及以上城(cheng)市人民(min)政(zheng)府要加強政(zheng)務大廳建(jian)設(she)(she),發揮(hui)服務企業(ye)群眾、監督協調(diao)審批的(de)作(zuo)用。整合(he)各(ge)部門和各(ge)市政(zheng)公(gong)用單位分散設(she)(she)立的(de)服務窗(chuang)(chuang)口(kou)(kou)(kou),設(she)(she)立工(gong)程(cheng)(cheng)建(jian)設(she)(she)項(xiang)(xiang)目審批綜(zong)合(he)服務窗(chuang)(chuang)口(kou)(kou)(kou)。建(jian)立完(wan)善“前臺受(shou)理、后臺審核”機制,綜(zong)合(he)服務窗(chuang)(chuang)口(kou)(kou)(kou)統(tong)一收件、出件,實現“一個窗(chuang)(chuang)口(kou)(kou)(kou)”服務和管理。省級人民(min)政(zheng)府要統(tong)一制定本地區(qu)“一窗(chuang)(chuang)受(shou)理”的(de)工(gong)作(zuo)規程(cheng)(cheng)。鼓勵為申(shen)請人提供工(gong)程(cheng)(cheng)建(jian)設(she)(she)項(xiang)(xiang)目審批咨詢(xun)、指導、協調(diao)和代辦等服務,幫助企業(ye)了(le)解審批要求,提供相關工(gong)程(cheng)(cheng)建(jian)設(she)(she)項(xiang)(xiang)目的(de)申(shen)請材料清(qing)單,提高申(shen)報通過率。


(十四)“一張(zhang)(zhang)表單(dan)”整合申(shen)報(bao)(bao)材(cai)(cai)料(liao)。各審批(pi)階段均實(shi)行“一份辦(ban)事(shi)(shi)(shi)指南,一張(zhang)(zhang)申(shen)請表單(dan),一套申(shen)報(bao)(bao)材(cai)(cai)料(liao),完成多項審批(pi)”的(de)(de)運作模式,牽頭(tou)部門(men)制(zhi)定統一的(de)(de)辦(ban)事(shi)(shi)(shi)指南和(he)申(shen)報(bao)(bao)表格,每個審批(pi)階段申(shen)請人只(zhi)需提交一套申(shen)報(bao)(bao)材(cai)(cai)料(liao)。建立完善審批(pi)清單(dan)服(fu)務機制(zhi),主動為申(shen)請人提供項目需要審批(pi)的(de)(de)事(shi)(shi)(shi)項清單(dan)。不同審批(pi)階段的(de)(de)審批(pi)部門(men)應當共享申(shen)報(bao)(bao)材(cai)(cai)料(liao),不得要求申(shen)請人重復提交。


(十五)“一套(tao)機制”規(gui)范審(shen)(shen)批運(yun)行(xing)。建立健(jian)全工(gong)程建設(she)項目審(shen)(shen)批配(pei)套(tao)制度(du),明確部門職責,明晰工(gong)作(zuo)(zuo)規(gui)程,規(gui)范審(shen)(shen)批行(xing)為,確保審(shen)(shen)批各階段、各環節無縫(feng)銜接(jie)。建立審(shen)(shen)批協(xie)調機制,協(xie)調解決部門意(yi)見分歧(qi)。建立跟(gen)蹤(zong)督辦制度(du),實時跟(gen)蹤(zong)審(shen)(shen)批辦理情況,對全過程實施(shi)督辦。各級政府(fu)部門要主(zhu)動加強與人大(da)及司法(fa)機構(gou)的溝通協(xie)調配(pei)合,加快法(fa)律法(fa)規(gui)、規(gui)范性文(wen)件(jian)和標準規(gui)范的立改(gai)廢釋(shi)工(gong)作(zuo)(zuo),修改(gai)或(huo)廢止與工(gong)程建設(she)項目審(shen)(shen)批制度(du)改(gai)革要求不相符的相關制度(du),建立依法(fa)推進(jin)改(gai)革的長效機制。


五、統一監管方式


(十六)加強(qiang)事(shi)中事(shi)后監(jian)(jian)(jian)管(guan)。進一(yi)步(bu)轉變監(jian)(jian)(jian)管(guan)理念(nian),完善(shan)事(shi)中事(shi)后監(jian)(jian)(jian)管(guan)體系,統一(yi)規(gui)(gui)范事(shi)中事(shi)后監(jian)(jian)(jian)管(guan)模式,建立以“雙隨機(ji)、一(yi)公(gong)開”監(jian)(jian)(jian)管(guan)為(wei)基本手段,以重點(dian)監(jian)(jian)(jian)管(guan)為(wei)補充,以信(xin)用監(jian)(jian)(jian)管(guan)為(wei)基礎的(de)新(xin)型監(jian)(jian)(jian)管(guan)機(ji)制,嚴肅查處違法違規(gui)(gui)行為(wei)。對(dui)于實行告知承(cheng)諾(nuo)(nuo)制的(de)審批事(shi)項(xiang),審批部(bu)門(men)應(ying)當在規(gui)(gui)定時間內對(dui)承(cheng)諾(nuo)(nuo)人(ren)履行承(cheng)諾(nuo)(nuo)的(de)情況(kuang)進行檢(jian)查,承(cheng)諾(nuo)(nuo)人(ren)未履行承(cheng)諾(nuo)(nuo)的(de),審批部(bu)門(men)要(yao)依法撤銷行政審批決定并追(zhui)究承(cheng)諾(nuo)(nuo)人(ren)的(de)相應(ying)責任(ren)。


(十七(qi))加強(qiang)信(xin)(xin)用(yong)體(ti)系(xi)建(jian)設。建(jian)立工程建(jian)設項(xiang)目(mu)審批信(xin)(xin)用(yong)信(xin)(xin)息(xi)平(ping)臺(tai),完善申請人(ren)信(xin)(xin)用(yong)記錄(lu),建(jian)立紅黑(hei)名(ming)單制度,實(shi)行信(xin)(xin)用(yong)分級分類管理,出臺(tai)工程建(jian)設項(xiang)目(mu)審批守信(xin)(xin)聯(lian)合(he)激勵和(he)失(shi)信(xin)(xin)聯(lian)合(he)懲戒合(he)作(zuo)備忘錄(lu),對失(shi)信(xin)(xin)企(qi)業(ye)和(he)從業(ye)人(ren)員進(jin)行嚴格(ge)監管。將(jiang)企(qi)業(ye)和(he)從業(ye)人(ren)員違(wei)法違(wei)規、不履行承諾的(de)失(shi)信(xin)(xin)行為納入工程建(jian)設項(xiang)目(mu)審批管理系(xi)統,并與全(quan)國(guo)信(xin)(xin)用(yong)信(xin)(xin)息(xi)共享(xiang)平(ping)臺(tai)互聯(lian)互通,加強(qiang)信(xin)(xin)用(yong)信(xin)(xin)息(xi)共享(xiang),構(gou)建(jian)“一處失(shi)信(xin)(xin)、處處受限”的(de)聯(lian)合(he)懲戒機制。


(十八)規(gui)范中(zhong)介和市(shi)(shi)政(zheng)公(gong)用服(fu)務(wu)(wu)(wu)。建(jian)立健(jian)全中(zhong)介服(fu)務(wu)(wu)(wu)和市(shi)(shi)政(zheng)公(gong)用服(fu)務(wu)(wu)(wu)管(guan)(guan)理制度,實(shi)行服(fu)務(wu)(wu)(wu)承諾制,明(ming)確(que)服(fu)務(wu)(wu)(wu)標(biao)準和辦事流程(cheng),規(gui)范服(fu)務(wu)(wu)(wu)收費。依(yi)托工程(cheng)建(jian)設(she)項(xiang)目審批管(guan)(guan)理系統建(jian)立中(zhong)介服(fu)務(wu)(wu)(wu)網(wang)上交(jiao)易(yi)平臺,對中(zhong)介服(fu)務(wu)(wu)(wu)行為(wei)實(shi)施(shi)全過程(cheng)監管(guan)(guan)。供水(shui)、供電、燃氣、熱力、排水(shui)、通信等市(shi)(shi)政(zheng)公(gong)用服(fu)務(wu)(wu)(wu)要全部入駐(zhu)政(zheng)務(wu)(wu)(wu)服(fu)務(wu)(wu)(wu)大廳,實(shi)施(shi)統一規(gui)范管(guan)(guan)理,為(wei)建(jian)設(she)單位提供“一站(zhan)式(shi)”服(fu)務(wu)(wu)(wu)。


六、加強組織實施


(十(shi)九)強(qiang)化組織領(ling)導(dao)(dao)。住房城鄉(xiang)建(jian)(jian)(jian)設(she)(she)部要(yao)切(qie)(qie)實(shi)擔(dan)負起工(gong)程建(jian)(jian)(jian)設(she)(she)項目(mu)審批(pi)(pi)制(zhi)(zhi)度(du)(du)(du)改(gai)革(ge)工(gong)作的(de)組織協調(diao)(diao)和(he)督(du)促(cu)指導(dao)(dao)責(ze)任;各(ge)部門(men)要(yao)密切(qie)(qie)協調(diao)(diao)配(pei)合,加(jia)強(qiang)工(gong)程建(jian)(jian)(jian)設(she)(she)項目(mu)審批(pi)(pi)制(zhi)(zhi)度(du)(du)(du)改(gai)革(ge)、投資審批(pi)(pi)制(zhi)(zhi)度(du)(du)(du)改(gai)革(ge)等(deng)“放管服”各(ge)項改(gai)革(ge)任務的(de)協同(tong)聯動,形成(cheng)(cheng)改(gai)革(ge)合力。各(ge)省(sheng)級人民(min)(min)政府(fu)要(yao)按照本(ben)實(shi)施意見(jian)要(yao)求,全面領(ling)導(dao)(dao)本(ben)地(di)區工(gong)程建(jian)(jian)(jian)設(she)(she)項目(mu)審批(pi)(pi)制(zhi)(zhi)度(du)(du)(du)改(gai)革(ge)工(gong)作,加(jia)強(qiang)統(tong)籌協調(diao)(diao)、指導(dao)(dao)和(he)督(du)促(cu),為改(gai)革(ge)工(gong)作提供組織和(he)經費保障,積極推動各(ge)項改(gai)革(ge)措施落地(di)。各(ge)省(sheng)級人民(min)(min)政府(fu)要(yao)在本(ben)實(shi)施意見(jian)印發后1個月(yue)內制(zhi)(zhi)定具體實(shi)施方案(an),并報(bao)住房城鄉(xiang)建(jian)(jian)(jian)設(she)(she)部備案(an)。各(ge)地(di)方人民(min)(min)政府(fu)要(yao)高度(du)(du)(du)重視工(gong)程建(jian)(jian)(jian)設(she)(she)項目(mu)審批(pi)(pi)制(zhi)(zhi)度(du)(du)(du)改(gai)革(ge)工(gong)作,承擔(dan)改(gai)革(ge)主體責(ze)任,成(cheng)(cheng)立以主要(yao)負責(ze)同(tong)志(zhi)為組長的(de)領(ling)導(dao)(dao)小(xiao)組,明確(que)責(ze)任部門(men),制(zhi)(zhi)定時(shi)間表、路線圖,確(que)保按時(shi)保質完成(cheng)(cheng)任務。


(二十)加強(qiang)(qiang)溝(gou)通(tong)反(fan)饋和(he)培(pei)訓(xun)。住房城鄉(xiang)建(jian)設部要(yao)建(jian)立(li)上下聯動的溝(gou)通(tong)反(fan)饋機制,及時了(le)解地方(fang)工(gong)程建(jian)設項(xiang)目審批制度改革工(gong)作情況,督(du)促指導地方(fang)研究解決改革中遇(yu)到(dao)的問(wen)題(ti)(ti)。各地要(yao)針對(dui)重(zhong)點、難點問(wen)題(ti)(ti),采用(yong)集中培(pei)訓(xun)、網絡培(pei)訓(xun)和(he)專(zhuan)題(ti)(ti)培(pei)訓(xun)等方(fang)式,加強(qiang)(qiang)對(dui)各級(ji)領導干部、工(gong)作人員(yuan)和(he)申請人的業務(wu)培(pei)訓(xun),對(dui)相關(guan)政策進行全(quan)面解讀和(he)輔(fu)導,提高改革能力和(he)業務(wu)水平。


(二(er)十一(yi)(yi))嚴格督促落(luo)實(shi)(shi)。住房城鄉建(jian)設(she)部要(yao)會同(tong)相(xiang)關部門(men)建(jian)立工(gong)程(cheng)(cheng)建(jian)設(she)項(xiang)目(mu)審(shen)(shen)批制度改(gai)革(ge)(ge)評(ping)(ping)估評(ping)(ping)價(jia)機(ji)制,重點評(ping)(ping)估評(ping)(ping)價(jia)各地全流程(cheng)(cheng)、全覆蓋改(gai)革(ge)(ge)和統一(yi)(yi)審(shen)(shen)批流程(cheng)(cheng)、統一(yi)(yi)信息數據平臺、統一(yi)(yi)審(shen)(shen)批管(guan)理(li)體系(xi)、統一(yi)(yi)監管(guan)方式等情(qing)況(kuang),并將有(you)關情(qing)況(kuang)報國(guo)務院。地方各級(ji)人民政府(fu)要(yao)加大對地方有(you)關部門(men)工(gong)作的(de)督導力度,跟蹤改(gai)革(ge)(ge)任(ren)務落(luo)實(shi)(shi)情(qing)況(kuang)。各省(sheng)級(ji)人民政府(fu)要(yao)定期(qi)向住房城鄉建(jian)設(she)部報送(song)工(gong)作進(jin)展情(qing)況(kuang)。對于工(gong)作推進(jin)不力、影響工(gong)程(cheng)(cheng)建(jian)設(she)項(xiang)目(mu)審(shen)(shen)批制度改(gai)革(ge)(ge)進(jin)程(cheng)(cheng),特別是未按時完成階段性工(gong)作目(mu)標的(de),要(yao)依法(fa)依規嚴肅問(wen)責。


(二十二)做好宣(xuan)傳引(yin)導(dao)。各地要通(tong)過多種(zhong)形式及時宣(xuan)傳報道相關(guan)工(gong)(gong)作(zuo)措施和取得的成效,加強輿(yu)論引(yin)導(dao),增進社會(hui)公眾對工(gong)(gong)程建設項目審批制度改革工(gong)(gong)作(zuo)的了解和支(zhi)持,及時回應(ying)群(qun)眾關(guan)切,為順利推進改革營造(zao)良(liang)好的輿(yu)論環境。
